Mindset Training Course Terms & Conditions

Please take the time to read and understand the Mindset Training Course Terms & Conditions detailed below prior to signing up with YOGITRIATHLETE LLC, a California Limited Liability Corporation ("Host"), and the Client ("Athlete"). If you decide to engage with the Mindset Training Course provided by YOGITRIATHLETE, you will be required to confirm your agreement to these Terms & Conditions as part of the online registration process.

Your Registration is a Contract:
When you (“Athlete”) register for the 8-Week Mindset Training Course with YOGITRIATHLETE, you will be deemed to have agreed to these Terms & Conditions. Moreover, your registration, together with these Terms & Conditions and the details regarding the Mindset Training Course, will constitute a legally binding contract between the Athlete and YOGITRIATHLETE.

Pre-Payment:
The full balance for the course is due before the course commences. Please note that YOGITRIATHLETE does not provide refunds. It is your responsibility to access all content (videos, journal prompts, and community features) throughout the course duration.

Course Access and Content:
Athletes will have access to weekly course materials, including video lessons, journal prompts, and community support for the duration of the 8-week course. All content is delivered digitally, and it is the Athlete’s responsibility to participate in the course.

Cancellation and Non-Participation:
As this is a digital course, cancellation requests after the course begins will not be eligible for refunds. Non-participation in the course does not entitle the Athlete to a refund or credit.

Termination:
The Athlete may terminate their participation in the course at any time; however, no refunds or proration of fees will be issued after the course has started.

Photos and Marketing:
This Agreement grants full permission to YOGITRIATHLETE LLC, a California Limited Liability Corporation, to use any photographic material, video, or digital media of the Athlete for advertising, trade, and any other lawful purposes without compensation or notice. There is no time limit on the validity of this release, nor is there any geographic limitation on where these materials may be distributed. The Athlete grants permission to use their image, likeness, and sound of voice as recorded on audio or video without payment or any other consideration. The Athlete understands that their image may be edited, copied, exhibited, published, or distributed, and waives the right to inspect or approve the finished product.

Health Certification:
The Athlete confirms that they have not been recently treated for, nor are they aware of, any medical condition, infirmity, or disability (whether physical or mental) that would create an unreasonable risk to themselves or others in connection with the Mindset Training Course. Participation in the course is undertaken voluntarily, with full awareness of any physical or mental demands.

Limitation of Liability and Release:
The Athlete acknowledges and agrees that YOGITRIATHLETE and its parent, affiliates, subsidiaries, officers, directors, shareholders, members, employees, successors, and assigns (collectively, the “YOGITRIATHLETE Parties”) shall not be liable for any direct, indirect, consequential, or incidental damage, injury, loss, cost, or expense incurred by the Athlete in connection with their participation in the Mindset Training Course. The Athlete releases the YOGITRIATHLETE Parties from any and all claims, liabilities, losses, expenses, damages, demands, actions, lawsuits, or sums of money of any kind arising out of their participation in the course.

Privacy Policy:
Any personal information collected during the registration process or during the course may be used for purposes associated with the operation of the course or to send you marketing material in relation to other YOGITRIATHLETE events and special offers. Your information will not be shared with third parties without your consent, except as required by law.

Arbitration:
You agree that any dispute relating to your registration, these Terms & Conditions, or any other issues related to the services contracted with YOGITRIATHLETE shall be referred to confidential and binding arbitration in Carlsbad, California, pursuant to mutually agreed-upon arbitration rules. If parties cannot agree on the arbitrator or rules, arbitration may be compelled by petition to any court of competent jurisdiction in San Diego County, California. Any arbitration award shall be rendered in writing and may be fully enforceable as a judgment in a court of competent jurisdiction. Both parties expressly waive their right to a trial, including trial by jury. Each party shall bear its own attorney’s fees and costs.

Applicable Law:
This Agreement (including all registrations and these Terms & Conditions) shall be governed by the laws of the State of California, applicable to contracts entered into and wholly performed therein (without regard to any conflict of law principles under California law).
